This Privacy and Cookie Policy (the "Policy") describes our practices in connection with any information and Personal Data that we collect through the TweakFS website or our desktop and mobile app services. By providing Personal Data to us or using our Services, you agree to the terms and conditions of this Policy.

Personal Data

For the purpose of this Privacy Policy, "Personal Information" or "Personal Data" means any information relating to an identified or identifiable individual. If you do not provide Personal Information when requested, you may not be able to benefit from our Products and Services if that information is necessary to provide you with the service or if we are legally required to collect it.

So that we can accept purchase requests, provide products and send registration information, we keep records of some kinds of Personal Data that you choose to voluntarily provide to us. These include login credentials, names, email addresses, telephone numbers and postal addresses. This Personal Information serves to positively identify you and to provide you with any purchased products.

These personal details are also contained in "Notification of Payment Received" emails that are sent by our payment processor, PayPal and by the Google Play Store. They are also requested when you set up an account on TweakFS.

We do not request or store any financial information on our website such as credit card numbers. PayPal and Google Play, who receive payments on our behalf, may store those details but only if you have given them this permission previously. They do not send us this financial information and we do not need these details in order to fulfill your order.

Please note that you may be sent to PayPal or Google Play via a button or link on our website, such as to download an app or make a payment. We do not have access to or control over such third parties and encourage you to consult the privacy notices provided by those third parties.

We do not collect, maintain, or use Personal Information of children under the age of 16 years, and none of our products and services are directed at minors. If you learn that your child has provided us with Personal Information without your consent, please alert us at privacy@tweakfs.com. If we learn that we have collected any Personal Information from a child under 16, we will promptly delete the information.

How We Use Personal Data

We use personal contact information to deliver product registration keys, provide support and notify you of any updates.

Several times a year we may also send out a newsletter to registered customers to provide news, tips and upcoming products that may be of interest. No newsletter emails are ever sent unless the customer has explicitly turned on their newsletter option in their TweakFS account (this option is off by default). You can also opt out of these communications at any time by responding to the email message with the word "REMOVE" as a reply.

Only authorised TweakFS personel have access to your Personal Data. We do not share, sell or in any other way pass on this Personal Information to any third-party, individual, company or organisation. The only execption to this would be if required to do so by Australian/International law, or by law-enforcement authorities.

Your Rights & Choices

Any Personal Information we have in our records can be viewed by accessing your "My Account" page after logging in to your TweakFS account. This information belongs to you and you have the right to see what information we hold, make corrections or if you wish, have this information deleted from our records.

If you prefer us not keep a record of your Personal Information you can request this via our support email and after we confirm your identity (appropriate ID required) we will erase the information by deleting your account. Please keep in mind that in such cases you will need to keep a personal, restorable backup of registration keys and we may not be able to replace them for free if you are affected by data loss or hard drive failure.

Non-Personal Data

Non-Personal Information such as activity logs are used to gather standard "webstat" data which is automatically collected by most servers for anonymous statistical purposes (e.g. IP addresses, referrers, pages views, files downloads, etc). We use this information to assess how we can improve the site and make it more informative and user-friendly.

Browser cookies are used by TweakFS for authentication, storing site preferences and to keep track of your cart contents as you shop. At no time is any Personal Information contained in these plain text files which are stored in the users browser and can be deleted if so desired. If you disable cookies on your browser, some parts of the Services may not work fully.

TweakFS reserves the right to use server activity data to investigate any illegal activity such as attempts to hack the site, falsify account details, gain unauthorised access to the database or to verify the illegal use of a registered product that requires online activation. Such information will only be used in the context of protecting the site and TweakFS products from unauthorized distribution, file-sharing or piracy.

How We Protect Data

This site has security measures in place to protect the loss, misuse and alteration of other information under our control. By regularly monitoring and auditing the database we take every precaution to ensure this information is kept safe. We will only access your Personal Information when necessary as part of providing the kinds of services and support outlined above.

We shall use reasonable efforts to comply with the terms of this Policy and shall react promptly in order to correct any failure to do so. However, due the inherent open nature of the Internet, we cannot guarantee that communications between you and us or the Personal Data stored is absolutely secure.

TweakFS reserves the right to monitor and take preventative measures against any illegal activity involving any TweakFS Shop account such as piracy, registration code theft, unauthorized distribution, copying or hacking and any other practices that violate the law and the terms of our software agreement.
